The State Council rejects the appeal from the unlawful offers of Alstoom and Siemens.
The new trains will replace EMUS aging including the AM75 category that was built between 1975 and 1979.
The Belgian National Railways (SNCB) is proceeding with negotiations to finish the touches on a 12 -year framework to provide up to 600 EMUS for 3.4 billion euros, after the State Council refused to appeal against the choice of CAF as a favorite provider.
Separate calls were made by the uncomfortable offer providers, Siemens Mobility and Alstom. They were rejected by the State Council on September 19 and 24, respectively.
The best and last offer of CAF was chosen by SIEMENS and Alstom on February 28, after evaluating the tender based on four criteria: technical content (36 %), price (50 %), delivery schedule (7 %) and energy consumption (7 %). Although the final grades were close, Siemens and Alstom filed complaints to the State Council, claiming that assessing technical content lacks transparency and violating the purchasing law.
The State Council ruled that SNCB did not change the evaluation methodology after providing bids, and complied with the principles of buying the public sector. The Council also rejected an appeal by four Belgian NGOs (NGO), citing the participation of CAF continuous in the light railway project in Jerusalem, and a judge that the result of the tender to provide the shares of the operation in Belgium “does not affect the rights of the Palestinian people in any way.”
It contains a preliminary order for 180 EMUS worth 1.7 billion euros. The framework contract is essential in SNCB to meet its commitment to renew 50 % of its fleet during the current PSO contract with the federal government, as it extends from 2023 to 2032.
In addition to absorbing the expected growth in the passenger traffic, the new trains will improve the comfort of passengers, and replace EMUS aging subject to failure with more flexible and accessible trains that consume less energy.
The new EMUS was set as the AM30 category by SNCB, and will be published on the inter-services, regional and suburban services, to replace four AM75 cars, three AM80 cars and Three-Car Amus. CAF presented the CIFITY DUO design, combining one -dish cars with dual -range cars. SNCB will also order the Bemu variable to replace the AR41 DMUS.
In the tender, SNCB said that the new trains should be available from 2029-30, given the cloud schedule to replace the fleets. Therefore, the framework contract must be granted this fiscal year (2025-26) to obtain the initial request to be submitted next spring.
